1. Acceptance of Terms

These Terms & Conditions ("Terms") govern access to and use of The Climate Promise initiative, including the website theclimatepromise.org and the Climate Pledge form ("the Platform"), operated by Purple Umbrella Foundation ("we", "us", "our").

By submitting the Climate Pledge form, whether on your own behalf or on behalf of a student as a parent, guardian, or teacher, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not submit the form.

2. About the Platform

The Climate Promise is a free, non-commercial initiative run by Purple Umbrella Foundation, a Section 8 non-profit registered in India. The Platform enables individuals, students, schools, and communities to take a symbolic climate pledge and receive a digital certificate acknowledging their commitment.

The Platform is provided entirely free of charge. There are no fees for submitting a pledge, receiving a certificate, or participating in any aspect of the programme, now or in the future under these Terms.

3. Eligibility and Submission

Use of the Platform is open to all. However, the following rules apply to pledge submissions:

  • Students under the age of 18 may not submit the pledge form directly. All submissions on behalf of a minor must be made by a parent, guardian, or teacher.
  • By submitting on behalf of a student, the submitting adult confirms they have the authority to do so and that the information provided is accurate.
  • Each individual student should be submitted once. Duplicate submissions for the same student may be removed without notice.
  • There is no restriction on the number of students a teacher or school may submit.

4. The Climate Pledge

The Climate Pledge is a voluntary, personal commitment to adopt and practise eco-friendly habits in daily life. By submitting the pledge:

  • The student (or individual) commits to practising a minimum of three chosen eco-friendly habits on a regular basis.
  • The pledge is a personal commitment and carries no legal obligation.
  • We do not monitor, verify, or enforce compliance with the pledge habits. Participation is based entirely on good faith.

5. Digital Certificate

5.1 Nature of the certificate: Upon successful submission of the pledge, a digital certificate will be issued acknowledging the pledge. This certificate is symbolic in nature. It does not constitute an academic qualification, a government-recognised award, or an official credential of any kind.

5.2 Sharing and use: The certificate may be freely shared by the recipient, their school, or their family for personal, educational, and non-commercial purposes, including:

  • Sharing on social media
  • Displaying in schools, classrooms, or community spaces
  • Including in student portfolios or school newsletters

The certificate may not be altered, falsified, or presented in a way that misrepresents its nature or implies official government or academic recognition.

5.3 Issuance: We will make reasonable efforts to issue certificates promptly following submission. However, we do not guarantee a specific delivery timeframe. If you do not receive your certificate within a reasonable period, contact us at info@theclimatepromise.org.

6. Intellectual Property

All content on the Platform, including the Climate Promise name, logo, certificate design, website text, and programme materials, is owned by or licensed to Purple Umbrella Foundation.

You are permitted to:

  • Share the digital certificate freely for non-commercial purposes
  • Reference The Climate Promise by name when describing participation in the programme
  • Use the Climate Promise name and certificate in school communications, social media posts, and community activities

You may not:

  • Reproduce or use the Climate Promise logo, name, or branding in any commercial context without our prior written consent
  • Create derivative works from the certificate design or programme materials
  • Imply endorsement by Purple Umbrella Foundation or The Climate Promise for any product, service, or organisation without our prior written consent

7. Acceptable Use

When using the Platform, you agree not to:

  • Submit false, misleading, or fabricated information
  • Submit pledges for individuals without their knowledge or the knowledge of their parent or guardian
  • Use the Platform for any commercial purpose or financial gain
  • Attempt to disrupt, damage, or gain unauthorised access to the Platform or its underlying systems
  • Use the Platform in any way that violates applicable Indian law or the rights of any third party

We reserve the right to remove any submission or block access to the Platform where we have reasonable grounds to believe these Terms have been violated.

8. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

  • The uninterrupted or error-free operation of the Platform
  • The accuracy or completeness of any content on the Platform
  • The environmental impact of any individual's pledge habits

The programme statistics published on the Platform (including pledge counts and school participation figures) are based on submitted data and are not independently verified.

9. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Purple Umbrella Foundation shall not be liable for any direct, indirect, incidental, or consequential loss or damage arising from:

  • Use of or inability to use the Platform
  • Any errors or omissions in Platform content
  • Delay or failure in issuing a certificate
  • Any reliance placed on the symbolic nature of the pledge or certificate

Our total liability in any circumstance shall not exceed the amount paid by you to access the Platform. Since the Platform is free, this amount is zero.

10. Third-Party Links and Services

The Platform may contain links to third-party websites or services (such as school websites or social media platforms). We are not responsible for the content, privacy practices, or terms of any third-party sites. Accessing third-party links is at your own risk.

11. Suspension and Termination

We reserve the right to suspend or terminate access to the Platform, or to discontinue the Climate Promise programme entirely, at any time and without prior notice. In such circumstances, we will make reasonable efforts to notify submitting adults via the email address provided.

Termination of the programme does not affect the validity of certificates already issued.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Gurgaon, Haryana, India.

We encourage you to contact us first at info@theclimatepromise.org before initiating any formal dispute. We will make every reasonable effort to resolve concerns informally.

13. Changes to These Terms

We may update these Terms from time to time. When changes are made, we will update the effective date at the top of this document. Where changes are material, we will notify submitting adults via email where possible.

Continued use of the Platform after updated Terms are posted constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, you should discontinue use of the Platform.
